Schedule 5: 5G redcap data plans

If Customer subscribes to the 5G redcap data plan service (the “Service”), Customer agrees to the following additional terms and conditions. The definition “Customer” under this Schedule shall include Customer’s Authorized Users.

  1. The wireless communication network underlying the Service is provided by certain network operators (the “Underlying Carriers”). The Customer obtaining the Service from the Provider agrees and acknowledges that Customer has no contractual relationship with Underlying Carrier, and Customer is not a third-party beneficiary of any agreement between or among the Underlying Carrier and any of its distributors or resellers through one or more tiers (for the purposes of these terms, each a “Reseller”). Customer understands and agrees that Underlying Carrier and Resellers shall have no legal, equitable or other liability of any kind to the Customer.
  2. Customer agrees and acknowledges that any coverage description or coverage map of the Service depicts predicted and approximate wireless service coverage. The coverage description or coverage map shown does not guarantee service availability and may include locations with limited or no coverage. Even within a coverage area, there are many factors, including Customer’s equipment, terrain, proximity to buildings, foliage, and weather that may impact service.
  3. Customer acknowledges that the Service may be temporarily refused, interrupted, curtailed or limited because of atmospheric, terrain, or other natural or artificial conditions and may be temporarily interrupted or curtailed due to usage concentrations, modifications, upgrades, relocation and repairs of transmission network. Customer agrees that neither Underlying Carrier nor any Resellers shall be responsible for such interruptions of the Service or the inability to use the Service within or outside the Service territory published by Provider. Customer understands that the Underlying Carriers and the Resellers cannot guarantee the security of wireless transmissions and will not be liable for any lack of security relating to the use of the Service.
  4. Customer expressly understands and agrees that the liability and obligations of a Reseller to Customer under the agreement for the Service may be strictly controlled and limited by Underlying Carrier’s tariff, if any, and the laws, rules and regulations of the Federal Communications Commission and other United States or foreign governmental authorities which from time to time have jurisdiction. In any event, regardless of the form of action, whether for breach of contract, warranty, negligence, strict liability in tort or otherwise, Customer’s exclusive remedy and the total liability of Underlying Carrier or any Reseller and/or any supplier of services to a Reseller arising in any way in connection with the Service, for any cause whatsoever, including but not limited to any failure or disruption of service provided, shall be limited to damages in an amount equal to the amount charged to Customer for the Service provided hereunder. In no event shall any Reseller and/or Underlying Carrier be liable for any cost, delay, failure or disruption of the Service, lost profits, or incidental, special, punitive or consequential damages. Customer shall refrain from using the Services to perform illegal activities, or damage the reputation or rights of Underlying Carriers, the Resellers, Provider or any third parties (for example by sending unsolicited messages or causing a breach of intellectual property rights)
  5. In no event shall Reseller and/or Underlying Carrier be liable for the failure or incompatibility of equipment utilized by Customer in connection with the Service. Customer shall use equipment provided at its own risk.
  6. Customer shall indemnify, defend and hold Provider, the Resellers and Underlying Carriers and the officers, employees and agents of each of them harmless from and against all claims, causes of action, losses, expenses, liability or damages (including reasonable attorneys’ fees and costs), and including without limitation for any personal injury or death, arising in any way directly or indirectly in connection with the Service; the provision or use of the Service; or the use, failure to use or inability to use the Service. This provision shall survive the termination of the Agreement.
  7. Customer acknowledges and agrees that the Service is supplied solely as a failover connection to Customer’s primary internet service, and shall restrict its use of the Service only for such failover purposes and not as a primary or persistent connection.
  8. Service may be temporarily suspended or permanently terminated without notice in the event that (i) the applicable Reseller’s agreement with Underlying Carrier is terminated or in the event the Customer violates the Underlying Carrier’s acceptable use policy or other network rules and policies; or (ii) the Service is used in breach of any condition regarding its use. Customer waives any and all claims against the Underlying Carrier and its Resellers, including any roaming carrier, for such suspension or termination.
  9. Customer shall not use, or facilitate or allow others to use, the Service: (i) for any illegal or fraudulent activity; (ii) to violate the rights of others; (iii) to threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm; (iv) for any content or activity that is harmful, unwanted, inappropriate, objectionable, or promotes child sexual exploitation or abuse; (v) to violate the security, integrity, or availability of any user, network, computer or communications system, software application, or network or computing device; (vi) to distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations; (vii) to interfere with or otherwise negatively impact any aspect of the Service or any third-party networks that are linked to the Service; or (viii) to reverse engineer, copy, disassemble, or decompile the Service.
  10. Customer shall not: (i) attempt to bypass, exploit, defeat, or disable limitations or restrictions placed on the Service; (ii) find security vulnerabilities to exploit the Service or attempt to bypass any security mechanism or filtering capabilities; (iii) conduct any denial of service (DoS) attack using the Service or any other conduct that attempts to disrupt, disable, or overload any website, application or network; (iv) transmit code, files, scripts, agents, or programs intended to do harm, including viruses or malware, or using automated means, such as bots; or (v) attempt to gain unauthorized access to any website, application or network.
  11. Notwithstanding any terms to the contrary in the Agreement, the Underlying Carriers are intended third-party beneficiaries of this Schedule solely for purposes of enforcing the disclaimers, waivers, limitations of liability, suspension and termination rights, use restrictions, and indemnities in this Schedule.
